Public Offer (Terms of Sale)

Version of 7 October 2026.

This agreement is a public offer by Sole Proprietor Nataliia Serhiivna Nykytska, who sells Babylon footwear, clothing and accessories through the online store babylon.net.ua. Under Articles 633 and 641 of the Civil Code of Ukraine, the terms are the same for every buyer. By placing an order, the buyer accepts these terms in full. This is a translation; if the texts differ, the Ukrainian version prevails.

2. Definitions

  • Seller — the person named in Section 1.
  • Buyer — a person with full legal capacity who buys goods for personal use, or a company or sole proprietor.
  • Website — the online store at https://babylon.net.ua (Ukrainian, Russian and English versions).
  • Goods — footwear, clothing and accessories presented on the Website.
  • Order — the Buyer’s request to buy selected goods, placed on the Website or through a manager.

3. Subject of the agreement

3.1. The Seller transfers ownership of the goods to the Buyer, and the Buyer pays for and accepts them on these terms.

3.2. The agreement is concluded at a distance, in electronic form, under the Law of Ukraine “On Electronic Commerce”.

4. Placing an order

4.1. Orders are placed on the Website via the cart (the “Confirm Order” button) or “Quick order”, or by phone or messenger using the contacts in Section 1.

4.2. The Buyer provides first and last name, phone number, delivery address and, optionally, an email address. The Buyer is responsible for the accuracy of this information.

4.3. By placing an order, the Buyer confirms that they have read and agree to this agreement, the Returns & Exchanges Policy and the Privacy Policy.

4.4. The agreement is concluded when the Seller confirms the order: a manager contacts the Buyer (daily 9:00–23:00 Kyiv time), or the Buyer receives confirmation on the “Order placed” page or by email.

4.5. If an item is out of stock, the manager informs the Buyer and offers another size or model, waiting for restock, or cancellation with a full refund of any amount paid.

4.6. Items marked “Made to order” are produced or restocked after the order is placed. The manager states the lead time before confirming the order.

5. Prices

5.1. For international orders (the English version of the Website and buyers outside Ukraine), prices are shown in euros (€) and already include international shipping. Import duties, taxes and fees of the destination country (if any) are paid by the Buyer.

5.2. For orders within Ukraine, prices are shown in Ukrainian hryvnias (₴) and do not include Nova Poshta delivery.

5.3. The Seller may change prices on the Website. The price of a confirmed order does not change.

6. Payment

6.1. International orders are paid online by bank card on the secure page of the payment provider (Stripe or WayForPay).

6.2. Orders within Ukraine can also be paid cash on delivery at Nova Poshta (with a 200 UAH prepayment), by card via WayForPay, with monobank “Pay in parts”, or in cash at a showroom on pickup.

6.3. Card details are processed by the payment provider; the Seller does not receive or store them.

7. Shipping

7.1. International orders ship from Kharkiv, Ukraine, via national postal services and partner couriers, usually within 14–20 days depending on the country. Shipping is included in the price.

7.2. Within Ukraine, Nova Poshta delivers in 1–5 days; delivery costs from 200 UAH at Nova Poshta rates and is paid by the Buyer. See Payment and Delivery.

8. Receiving the goods

8.1. On receipt, the Buyer checks the parcel and the goods (packaging, quantity, model, size, colour, visible damage). If something is wrong, the Buyer records it with the carrier where possible and informs the Seller.

8.2. Ownership and the risk of accidental damage pass to the Buyer on receipt of the goods.

9. Returns and exchanges

9.1. International orders: unworn items in original condition and packaging can be returned or exchanged within 30 days of delivery. Orders within Ukraine: within 14 days of receipt under the Law of Ukraine “On Consumer Rights Protection”.

9.2. Before sending a return, the Buyer contacts the manager at babylon.obrash@gmail.com or by phone; the manager confirms the return and provides the address.

9.3. Return shipping for non-defective items is paid by the Buyer. For defective or wrong items, the Seller covers return shipping.

9.4. Refunds are made to the original payment method within 20 days after the Seller receives the returned item (orders within Ukraine — no later than 30 calendar days). Import duties and taxes are not refunded by the Seller.

10. Warranty

10.1. Footwear carries a 30-day warranty from the date of receipt.

10.2. If a manufacturing defect appears during the warranty period, the Buyer sends a description and photos; the Seller repairs, replaces or refunds the item in accordance with the law. The warranty does not cover damage from improper wear or care, mechanical damage or normal wear and tear.

11. Fit adjustments to the Buyer’s feet

11.1. A catalogue model can be made to fit the width of the Buyer’s foot, instep height or anatomical features. Materials, colours and design stay the same.

11.2. Availability, price, lead time, payment and return terms for such orders are agreed with the manager before the order is placed and confirmed to the Buyer in writing.

11.3. The Buyer is informed in advance that an item made to their individual measurements has individually defined properties, so a return of such an item of proper quality may not be accepted where the law allows. The Buyer’s rights regarding defective goods remain in full.

12. Personal data

By placing an order, the Buyer consents to the processing of their personal data to fulfil the order. Data is shared only with those involved in fulfilling it (carriers, payment providers). See the Privacy Policy.

13. Liability

13.1. The parties are liable under the law of Ukraine and this agreement. The Seller is not liable for carrier delays or for consequences of incorrect information provided by the Buyer. Colours on screen may differ slightly from the actual product.

13.2. The parties are released from liability if non-performance is caused by force majeure (including hostilities, decisions of authorities, communication or carrier outages).

14. Disputes

Disputes are settled by negotiation; complaints can be sent to info@babylon.net.ua. If no agreement is reached, disputes are resolved under the law of Ukraine. This does not affect any mandatory consumer rights in the Buyer’s country of residence.

15. Term and changes

The agreement remains in force until both parties have fulfilled their obligations. The Seller may change these terms by publishing a new version on this page; each order is governed by the version in force when it was placed.
